"Customer," "you," or "your" refers to the individual or business entity who subscribes to our fuel delivery services and uses the Website. "Monthly Service Charge" refers to the recurring fee for the convenience and scheduling of our fuel delivery service, in addition to the price of the fuel itself. "Fuel" refers to the gasoline, diesel, or other fuel types available for delivery to your vehicle.

2. Acceptance of Terms: By using our website and services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use our services or Website.

3. Service Description: Pumped Fueling Solution offers on-demand and scheduled fuel delivery services to vehicles at the customer’s home or work location. Our service includes Scheduling fuel deliveries via our website, mobile app, or customer support. On-demand fueling based on customer requests for immediate fuel delivery. Regular scheduled deliveries as part of your monthly service plan. The prices for fuel and service charges are subject to change based on market rates, and any adjustments will be communicated to customers via email or through the Website.

4. Account Registration: To use our services, you agree to: Provide accurate, current, and complete information during the registration process and keep your account information up to date. Maintain the confidentiality of your account credentials.

5. Service Charges and Payment Monthly Service Charge: You agree to pay a monthly service charge for the convenience of scheduling fuel deliveries, in addition to the price of the fuel itself. This service charge is non-refundable. Fuel Pricing: The price of the fuel delivered will vary depending on the current market rate. Payment Terms: All payments for services and fuel are due at the time of delivery and will be billed within two business days. We accept various payment methods, including credit and debit cards. By using our service, you authorize us to charge your selected payment method for all services and fuel deliveries. You authorize Pumped Fueling Solution to automatically charge your account for recurring monthly service fees and any applicable delivery charges. You may cancel or modify your subscription at any time by contacting us, subject to the cancellation policy outlined in Section 7.

6. Fuel Delivery Scheduling: You can schedule deliveries on a one-time basis or set up a recurring monthly schedule via a phone call or text. Delivery times are estimated, and while we strive to meet scheduled delivery windows, delays may occur due to weather, traffic, or other unforeseen circumstances. You agree to provide an accessible and safe location for the delivery of fuel to your vehicle. You acknowledge that our drivers will only deliver fuel to vehicles parked at the designated address that comply with safety and legal regulations.

7. Cancellations and Refunds Cancellations: You may cancel a scheduled fuel delivery up to 4 hours before the scheduled delivery time. Cancellations made within 4 hours of delivery are subject to a cancellation fee equal to 25% of the scheduled delivery cost. Refunds: If you believe there was an error in your fuel delivery, such as an incorrect amount of fuel, incorrect billing, or any other mistake, please contact us within 48 hours. We will investigate the issue and, if applicable, issue a refund or credit to your account.

8. Responsibilities of the Customer Accuracy of Information: You agree to provide accurate information regarding the vehicle's fuel needs, including the type of fuel required (e.g., gasoline or diesel), the vehicle’s fuel tank capacity, and any other details that may affect the fueling process. Vehicle Access: You are responsible for ensuring that your vehicle is easily accessible for fuel delivery and that the vehicle is in a safe location for our fueling equipment to operate. Fuel deliveries cannot be made to vehicles that have the fuel door locked or inaccessible. Safety: You must ensure that the vehicle is in good condition and that the fueling location complies with all local regulations. Fueling will not be performed in unsafe conditions, including but not limited to leaking tanks, improperly maintained vehicles, or areas with fire hazards. Compliance: You agree to comply with all applicable laws and regulations related to the fueling of vehicles.

9. Delivery Restrictions: Our services are available only in the areas covered by Pumped Fueling Solution's delivery network. Please check our website for a list of locations where we operate. We do not deliver fuel to vehicles that are unregistered, uninsured, or in violation of any legal requirements. We may refuse service to customers who violate these Terms and Conditions or engage in unlawful activities.

10. Limitation of Liability: To the maximum extent permitted by law, Pumped Fueling Solution will not be held liable for any damages, losses, or injuries arising from the use of our services, including but not limited to any loss of fuel, property damage, personal injury, or damage to your vehicle resulting from the delivery process. Force Majeure: We are not liable for any delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, technical failures, strikes, or governmental actions.

11. Privacy and Data Protection: We respect your privacy and handle your personal data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your data as described in our Privacy Policy.

Termination of Services: We reserve the right to suspend or terminate your access to our services at any time, with or without cause, including but not limited to violations of these Terms and Conditions.
